Marianela Martinez, 45; Mireya Amechazurra, 49; Lissett Jo-Moure, 55; Omar Hernandez, 48; and Celia Santovenia, 49, were each indicted in a massive $48 millionhealth care fraud scheme. These indictments follow the sentencing of Rogelio Rodriguez and Raymond Aday to 108 and 51 months in prison, respectively. The new indictments which concern Marianela Martinez, Mireya Amechazurra, Lissett Jo-Moure, Omar Hernandez, and Celia Santovenia are limited to allegations of accepting kickbacks and bribes for referring patients to Caring Nurse and Quality Home Health.
Specifically, each has been indicted with one count of conspiracy to receive payment of kickbacks in health care fraud and two counts of receiving kickbacks in connection with a Federal health care program.
These charges carry a maximum penalty of five years in prison upon conviction.
As a Miami criminal attorney, I can tell you that South Florida is probably the worst place a person or group of people can commit a health care fraud scheme. This is because South Florida has the highest rate of health care fraud in the country and is under heavy scrutiny by Federal and State law enforcement.
